What’s the difference between HOA Rules & CC&R’s?

PhinneyTownHouseIf you live in a planned housing development, a town home community or condominium community you are likely familiar with the Associations Rules (or House Rules) and CC&R’s (Covenants, Conditions and Restrictions). If you are considering moving into a neighborhood like one of these, you may be curious what the difference is between HOA Rules & CC&R’s, this article poses some interesting questions on what the difference is and what is acceptable and what is not when changing or amending the rules.  The main difference to remember, as a homeowner, is that CC&R’s require a vote by homeowners to amend the document and House Rules can be amended simply by a board vote, after advance notice to the community. There are many rules, restrictions and laws associated with community living, another recommendation for HOA’s is to seek the guidance of a professional Community Association Manager.  The goal of the Community Association Manager is to offer an outside voice and expertise that will help the homeowners and board members reach a consensus that will allow the community to set and accomplish common goals.
